Vale Estate – Terms and Conditions
Effective from: 1st May 2025
These Terms and Conditions apply to all services provided by Vale Estate, including landscaping, garden maintenance, and irrigation, to clients within the United Kingdom.
1. Definitions
- “Company” refers to Vale Estate.
- “Client” refers to the person or business who commissions work from Vale Estate.
- “Services” refers to the landscaping, garden maintenance, and irrigation services provided by Vale Estate.
- “Agreement” refers to the contractual relationship between the Client and Vale Estate, governed by these Terms.
2. Quotations and Estimates
- All quotations are valid for 30 days from the date issued.
- Any changes to the scope of work requested after acceptance may incur additional charges.
- Vale Estate reserves the right to revise quotations should material or labour costs change significantly.
3. Bookings and Cancellations
- A date for work will be agreed once a quote is accepted.
- Cancellations must be made at least 48 hours in advance of scheduled work.
- Late cancellations may incur a £50 charge to cover lost time and costs.
4. Payment Terms
- Invoices must be paid within 7 days of receipt, unless otherwise agreed in writing.
- Late payments will incur a £25 administration fee and may also be subject to interest under the Late Payment of Commercial Debts (Interest) Act 1998.
- Ongoing or scheduled work may be suspended until outstanding invoices are settled.
- Vale Estates reserves the right to request full or partial payment in advance for materials required to carry out the agreed services. This may be a fixed sum or a percentage of the total cost of materials.
- Work may not commence until the requested advance payment has been received in full. Failure to provide the requested payment may result in delays or cancellation of the scheduled works.
5. Access and Site Conditions
- The Client is responsible for ensuring Vale Estate has appropriate access to the site at the agreed times.
- Any delays due to lack of access or unsafe site conditions may result in additional charges.
6. Materials and Waste
- Materials remain the property of Vale Estate until full payment is received.
7. Liability
- Vale Estate will carry out all work with reasonable skill and care.
- The Company is not liable for damage caused by weather, pest infestations, or acts of nature.
- Clients must notify Vale Estate of any underground services (pipes, cables, etc.) before work begins. Failure to do so may result in the Client being liable for any damage caused.
8. Guarantees
- Any guarantees on plants, turf, or irrigation systems will be outlined specifically in the quote or invoice.
9. Insurance
- Vale Estate holds full Public Liability Insurance. Evidence can be provided upon request.
10. Termination of Agreement
- Either party may terminate the agreement with 7 days’ written notice.
- Vale Estate reserves the right to terminate immediately if the Client breaches the Terms, including non-payment.
11. Data Protection
- Client details are stored securely and used only for the purposes of delivering our services, in line with UK GDPR regulations.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
